Does Georgia's Comparative Negligence Law Apply to Your Case?

Georgia has modified comparative negligence. If it has been determined that your negligence was less serious than the defendant's negligence, it is possible for you to recover. Your "fault" has to be 49% or less to make a recovery. The recovery, in turn, is then based on the remaining (defendant's) "fault." To determine fault in Georgia, you must prove that the liable party was negligent for one of three reasons:

  • The other party failed to carry out a key responsibility; and, as a result of this error of omission, you suffered injury.
  • The party's irresponsibility directly caused you to suffer injury.
